These Terms of Use (“Terms”) govern your use of the If I Must mobile application (“App”) and related website at ifimust.com (the “Site”). The App is provided by If I Must, LLC (“we,” “us,” or “our”).

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App

If I Must is a personal tool for organizing names and connections you enter yourself. The App runs on your Apple device. Optional sync uses your Apple iCloud account; we do not operate servers that store your memory graph.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, subject to these Terms and Apple’s App Store terms. You may not copy, modify, reverse engineer, sell, or redistribute the App except as allowed by law or with our written permission.

3. Your Content

You retain ownership of the information you enter in the App. You are responsible for the accuracy and legality of what you store. Do not use the App to store information you do not have the right to keep or that violates any law.

We do not claim ownership of your content. Because we do not host your data on our servers, we cannot recover lost data for you. You are responsible for maintaining backups (including optional JSON export in App Settings) and for your iCloud account settings.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to interfere with the App’s operation or security
  • Misrepresent your identity when contacting us
  • Use the App in any way that could harm us, other users, or third parties

We may suspend or stop offering the App if we reasonably believe you have violated these Terms.

5. Apple and Third Parties

The App is distributed through the Apple App Store. Your use of the App is also subject to Apple’s applicable terms, including the Licensed Application End User License Agreement.

Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Any claims related to the App are between you and us, not Apple.

Features such as iCloud sync, Contacts, and Mail are provided by Apple. We are not responsible for Apple services or for outages, data loss, or settings on your device or iCloud account.

6. Privacy

Our Privacy Policy explains how the App handles information. By using the App, you also agree to the Privacy Policy at ifimust.com (privacy page).

7. Disclaimer of Warranties

THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or that it will meet your requirements. You use the App at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP OR SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR US $50 IF THE APP WAS FREE).

9. Indemnity

You agree to defend and indemnify us against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your content, or your violation of these Terms.

10. Changes

We may update the App or these Terms from time to time. If we change these Terms, we will post the updated version on our website and update the “Last updated” date. Continued use of the App after changes means you accept the revised Terms.

11. Termination

You may stop using the App at any time by deleting it from your device. We may discontinue the App or Site at any time without liability. Sections that by their nature should survive (including disclaimers, limitations of liability, and indemnity) will survive termination.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction.

13. General

If any part of these Terms is held invalid, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the App.
